By accessing the Mutual Fund Investment Platform (“Investment Platform”) on the mobile application of Amica Financial Technologies Private Limited (“Jupiter App”), the user undertakes to have read, understood and agreed to be legally bound by the terms of the following disclaimer:
Through the Investment Platform, Amica Investment Advisors Private Limited (“We”, “Us” or the “Company”), a company registered under the Companies Act, 2013, allows users to invest in, track and manage their investments in direct plans of mutual fund schemes (“Services”). From time to time, the Investment Platform may allow the users to invest in other investment products.
You do hereby allow RIA to utilize your KYC information such as identity (name, PAN, age etc.), address and signature for sending it to the AMC for the purpose of validation and to comply with the legal and regulatory requirements. You hereby accept that for any transactions that are submitted offline i.e. with wet signatures, the signature available in my KYC records would be used for signature verification. You agree and understand that you shall be solely liable to inform the Company / AMC in case of any change in your KYC information including change in signature/ signatories etc. and in the event of your signature not being updated, available or legible in KYC records, Company/AMC would be within its rights to carry out further checks to validate the authenticity of the request or reject any such offline request based on existing KYC information.
Having read and understood the content of the SID / SAI of the scheme, you hereby apply for units of the scheme. You have read and understood the terms, conditions, details, rules and regulations governing the scheme. You hereby declare that the amount invested in the scheme is through legitimate source only and does not involve designed for the purpose of the contravention of any Act, Rules, Regulations, Notifications or Directives of the provisions of the Income Tax Act, Anti Money Laundering Laws, Anti-Corruption Laws or any other applicable laws enacted by the Government of India from time to time. I/we have not received nor have been induced by any rebate or gifts, directly or indirectly in making this investment. You confirm that the funds invested in the Scheme, legally belongs to you. In event “Know Your Client” process is not completed by you to the satisfaction of the Mutual Fund/AMC/Company, (you hereby authorize the Mutual Fund, to redeem the funds invested in the Scheme, in favour of the applicant, at the applicable NAV prevailing on the date of such redemption and undertake such other action with such funds that may be required by the law.)You confirm that you do not have any existing Micro SIP/Lump sum investments which together with the current application will result in aggregate investments exceeding Rs. 50,000 in a year (Applicable for Micro investment only.) with the AMC
The information contained in the Investment Platform is for informational purposes only and nothing contained therein should be construed as investment advice (as defined under the Securities Exchange Board of India (Investment Advisers) Regulations 2013), or recommendations or solicitations to buy/sell/hold units of any mutual fund scheme. We make no representation or warranty (expressed or implied) to any user on the advisability of investing in the units of any mutual fund scheme. The past performance of any mutual fund scheme is not indicative of its future performance. Any information on the units of any mutual fund scheme provided on the Investment Platform should never be construed as our representation or endorsement for the same.
Such information is meant only as a guide and should not be the sole basis for making investment decisions. Before making investments, the user must independently determine the suitability of investing in units of mutual fund schemes, based on his/her risk appetite and goals. We advise the user to take appropriate professional advice from duly registered and qualified investment advisors, before making any investment decisions. The user agrees to assume complete and full responsibility for the outcomes of all of his/her investment decisions that he/she makes, including but not limited to losses if any that may be incurred by him/her. We shall not be responsible or liable for any direct, indirect, incidental, consequential, special, punitive or any other damages arising out of the user’s investments in units of mutual fund schemes.
We do not warrant, endorse or assume responsibility for any investment products offered by any issuer of units of mutual fund schemes and We will not be a party to, or be responsible in any manner, for any transaction between the user and the issuer of units of mutual fund schemes. All interactions, communication, dealings and transactions between user and the concerned AMC will be separate and independent dealings/transactions between only the user and the concerned AMC. We are not responsible for any dispute arising between the user and the concerned AMC. We do not have any control over such dealings and transactions and play no determinative role in the performance in respect of the same. The user acknowledges that We shall not be responsible or liable for any direct, indirect, incidental, consequential, special, punitive or any other damages (including loss of profit, loss or corruption of data, work stoppage, system malfunction) arising out of the use of the Investment Platform/ Jupiter App and/or use of information and content available on the Investment Platform/ Jupiter App and/or investing units of mutual fund schemes offered by a third-party provider, through the Investment Platform.
All mutual fund investments are subject to market risks. Please read all scheme related documents carefully before investing. We advise users to read relevant data and risk factors of various mutual fund schemes available in the Scheme Information Document (SID), Statement of Additional Information (SAI), Key Information Memorandum (KIM), etc. The value of any investment may rise and/or fall as a result of market changes and the Investment Platform/ Jupiter App is not intended to predict the actual performance and/or success of any mutual fund scheme and no assurances are given with respect thereto. Past performance is not indicative of future returns.
The Investment Platform may present indicative summaries, analysis and information related to different mutual fund schemes generated internally or sourced from third party entities. All summaries, analysis and information (including expense ratio, estimated returns, net asset value (“NAV”), etc.) are historical and for illustration purposes only, and is subject to change. The Investment Platform does not purport to disclose all risks and other significant issues relating to any mutual fund scheme. No representation is made as to the reasonableness of the assumptions made within or accuracy or completeness of any data on past performance of schemes or historical analysis and any other analysis of any mutual fund scheme.
We have taken due care and caution in the compilation of the information and content available on the Investment Platform, some of which may be sourced from third party entities. However, We do not represent or guarantee whatsoever the authenticity, quality, accuracy, correctness or completeness of any of the information and contents, and We do not assume any responsibility for the same. We specifically state that We cannot be held liable for any losses or damages (monetary, legal or otherwise), caused by any error, omission, interruption, deletion, defect in the information available on the Investment Platform, and/or resulting from investment in the units of mutual fund schemes, made on the basis of any information provided on the Investment Platform. Further, data (including transaction data) and other information may be obtained by Us from third-party entities, and We are not responsible for verifying the accuracy of the same. The information available on the Investment Platform will be updated from time to time. We reserve the right to rectify errors/discrepancies in the date and information provided on the Investment Platform, if any are observed or brought to our notice, at any point in time, without being liable for such errors/discrepancies.
The Investment Platform contains material in the form of inputs submitted by users and We accept no responsibility for the content or accuracy of such content. The Investment Platform is provided on an ‘as is’ and ‘as available’ basis and We do not make any representations or warranties as to the operation of the same. The user agrees that their use of the Investment Platform is at their own risk. We do not warrant that the contents of the Investment Platform, its servers, emails and other communication sent from the Investment Platform or the Jupiter App are free from viruses or other harmful properties and shall not be liable for damages of any kind arising from the same. The Jupiter App or the Investment Platform may not be compatible with the user’s device and/or operating system and We take no responsibility for the same. We do not guarantee that a user’s access to the Jupiter App or the Investment Platform will be uninterrupted or error-free. The Investment Platform and its services may be unavailable from time to time due to required maintenance, telecommunications interruptions, technical errors/ interruptions or other disruptions which hamper the continuous provision of services and the functioning of the Investment Platform.
Personal information of a user collected by Us will not be shared with any third-party, except for the cases specified in the ‘Terms and Conditions of Use’ (“Terms”) and ‘Privacy Policy’.
We hereby expressly disclaim any implied warranties imputed by the laws of any jurisdiction. We consider ourselves and intend to be subject to the jurisdiction only of the courts of Mumbai in India.
The user’s use of the Investment Platform and all information contained therein is governed by the ‘Terms’, ‘Privacy Policy’ and the terms of the above disclaimer, available on the Investment Platform or the Jupiter App. If the user does not agree with any of the terms of the disclaimer, or with the ‘‘Terms’ or ‘Privacy Policy’, the user shall not access the Investment Platform and immediately exit from the same. We reserve the right to make changes to the Investment Platform and the terms of this disclaimer, or the ‘Terms’ and ‘Privacy Policy’, at any time.
